Federal Judge Orders Freedom of Abrego Garcia from Immigration Custody

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration detention.

In her order, the judge noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Background of the Case

The legal challenge center on conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.

Conditions of Freedom

The judge, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
